The petitioner’s counsel, Barr. Usman Sule (SAN) has through one of his witnesses, Ibrahim Tudu Tukur tendered in evidence certified true copies of form (EC840G) which contained records of poling units where election was either not conducted or cancelled which the summary of the figures indicates that the poling units affected have the total (51,516) number of registered voters.
Ibrahim Tudu Tukur who is the APC supervisory collation officer in Zamfara stated that during the conduct of the election he has received complaints of non conduct of elections in some poling units from the APC agents, and he has tendered some before the Tribunal in his deposition.
When asked if the agents he made reference to are still alive, he said he does not know as of now?
He was also asked if he had visited some poling units and registration areas during the election he replied yes and noted that he cannot tell exactly the number of hours and minutes he spent even when asked by the PDP led counsel Mr. Atoyebi (SAN).
When asked if he had ever inspected the BVAS machine as well as the voter’s register as an APC supervisory collation officer, he replied “NO”.
He was challenged to tell the court how he arrived at his computation of the Maradun result as deposed to in his statement on oath, which he claimed contradicted the one used in declaring Dauda Lawal as winner of Zamfara Governorship election he said it was based on the documents brought by the INEC officials.
When asked to explain who made the analysis of the Maradun result for him he said, it was the INEC officials that made the analysis as contained in the duplicate of the result sheet tendered.
He was also asked to explain if the petitioners have tendered form EC8As for both Maradun local government and the rest, as they constitute the foundation of every election petition case, he replied, “I don’t know”.
He was also asked to clarify the confusion in the forms EC40G where Governorship and state assembly elections were mixed his answer was he cannot explain since the documents presented to him were not in clear shape.
Another witness from Talatar Mafara Awal Aliyu Marafa who was the local government collation agent for Mafara told the court that he had gathered most of the evidence leading to his deposition through reports from the poling unit agents appointed by his party, the APC.
When asked about reasons why elections were cancelled in some poling units mentioned by him, he stated that INEC is in a better position to explain hence the party agents had reported about the situation in the poling units affected.
