COURT OF APPEAL STRIKES APPEAL BY DAUDA LAWAL AND PDP OVER GOVERNORSHIP PRIMARIES.

The Court of Appeal sitting in Sokoto has strike out the Appeal filed by Dr. Dauda Lawal and PDP challenging the judgement delivered by Justice Aminu Bappa led Federal High Court where it nullified the governorahip primary election conducted on the 25th of May 2022.

The appellants namely Dr. Dauda Lawal, People’s Democratic Party, Col. Bala Mande rtf and Adamu Maina Waziri are asking the court of appeal to set aside the judgement of the lower court and allow the primary election conducted.

But the defendants in the appeal Engr. Ibrahim Shehu Gusau and Hafiz Nahuche filed a motion of preliminary objection and argued the same on the ground that, if the appellants knew they are going to appeal the judgement they should have not conceded on the first place and instead they should have filed a notice of stay of execution of the judgement.

The court of appeal in its judgement on Wednesday agreed with the defense tean and affirmed the position of the Federal High Court, Gusau by striking out the appeal.

It upheld that the PDP gubernatorial primary election conducted on the 25th of May 2022 was not In substantial compliance with the provisions of 2022 Electoral act as amended and PDP constitution, as well as PDP electoral guidelines.

It described the appeal as an academic exercise and dismissed it with a cost of N100,000 against the appellants.

Barrister Ibrahim Ali, one of the Counsels to Engr. Ibrahim Shehu and Hafiz Nahuche said the judgement by the Sokoto division of the Court of Appeal is an affirmation of the justice done by the lower court in Gusau.

Regarding the rumor of appeal made by the PDP in the second judgement, Ali said, to the best of their knowledge the appeal was not filed hence neither himself as the counsel nor his clients were served with any processes from the court of Appeal.
