The Sokoto division of the Court of Appeal is to deliver judgement on the motion of preliminary objection filed and argued by Engr. Ibrahim Shehu Gusau and Hafiz Nahuche alongside Dr. Dauda Lawal Dare and PDP by Wednesday the 23rd of November 2022.
Last week Friday counsels to Engr. Ibrahim Shehu Gusau had argued a motion of preliminary objection against the appeal filed by Dr. Dauda Lawal, Peoples. Democratic Party, Adamu Maina Waziri and Col. Bala Mande challenging the jurisdiction of the appellate court to entertain the appeal.
The parties also adopted their written final addresses in respect of the substantive appeal.
The court reserved judgement after the proceeding on Friday and promised to communicate to the parties the fixed date for ruling on the motion on notice.
Dr. Dauda Lawal and three other parties are praying for the court of Appeal Sokoto to set aside the judgement of the Federal High Court Gusau which nullified the primary election conducted on the 25th of May 2022.
Engr. Ibrahim Shehu and Hafiz Nahuche on the other hand are challenging the jurisdiction of the appellate court to entertain the appeal on the ground that same judgement has been conceded to by both parties; hence they have conducted fresh primary election as ordered by the Federal High Court Gusau.
A confided source within the camp of Engr. Ibrahim Shehu Gusau told this medium that they have received a communication from the court of appeal registry in Sokoto that Wednesday the 23rd of November 2022 has been slated for ruling on the motion of preliminary objection argued.
