A Federal High Court Abuja presided over by Justice Abang has dismissed a suit filed by Sani Abdullahi Wamban Shinkafi group Patriot for the Advancement of Peace and Social Development (PAPS) seeking for an order to compel Economic and Financial Crimes Commission EFCC to launch an investigation in to an allegation of misappropriation of N900 billion naira.

The group through its Chairman Sani Abdullahi Wamban Shinkafi prayed the court through an experte application to order the EFCC to act on the fifteen number of petitions filed against the former Zamfara Governor Abdul’azeez Yari at the EFCC headquarters Abuja.

But delivering ruling on the application Justice Abang dismissed it for lacking in merit arguing that it was filed out of time.

The judge said “in line with Order 34 Rule four of the Federal High Court Rules, applications such as the one by the applicant should be done within three months of receiving the reports and documents on which the plaintiff based his case”.

Justice Abang maintained that in line with the rules, the court lacks jurisdiction to extend the time for hearing such a matter.
