Sokoto’s division of the court of appeal has dismissed the appeal filed by the Yari faction of the APC challenging the dissolution of the Lawal M. Liman interim caretaker committee of the party in Zamfara.
It could be recalled that, Justice Aminu Bappa of the Federal High Court, Gusau had earlier dismissed the suite on the ground of lack of merit.
The judges of the Sokoto division of the court of appeal, however, were divided in determining the appeal a circumstance that resulted in the issuance of the majority and minority judgments.
According to the spokesperson of the party Mal. Yusuf Idris Gusau said in the majority Judgment delivered by Justice Precellia Mahmud and supported by Justice Danjuma Muhammad, the Court of Appeal dismissed the appeal and upheld the Judgment of the Federal High Court, Gusau which declined jurisdiction to entertain the matter for being purely an intra party affair.
Justice Fedrick Oho however, gave minority judgment and allowed the appeal by setting aside the Judgment of the Federal High Court, Gusau.
Reacting to the judgment, Chairman of the party Tukur Umar Danfulani said the party has received the judgment with high sense of joy and congratulate all APC members in the state for the victory at the court of appeal.
Danfulani said, with the judgment of the court of appeal it is an indicator that the Mai Mala Buni led caretaker committee has acted within the confine of the law.
He further said, Tukur Danfulani called on all the aggrieved parties to come back together and unite themselves as one in the overall interest of the progress of the party in the state.
